Welcome to BesideAI. These Terms of Service ("Terms") govern your access to and use of the BesideAI browser extension, website, and related services (collectively, the "Service"). Please read these Terms carefully before using our Service.

Acceptance of Terms

By installing, accessing, or using BesideAI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not install, access, or use the Service.

Description of Service

BesideAI is an AI-powered browser extension designed to enhance productivity. Our Service includes, but is not limited to:

• Real-time Meeting Translation: Live subtitles and translation for video conferencing platforms including Google Meet, Microsoft Teams, and Zoom, supporting over 30 languages.
• PDF Chat & Analysis: AI-powered document analysis allowing users to summarize, query, and extract insights from PDF files.
• Smart AI Chat: Context-aware AI assistant that can understand and interact with web page content.
• Screen Recording: Capture screen activity with optional webcam overlay and instant sharing capabilities.
• Web Capture: Full-page or selective screenshots with annotation tools.
• Gmail Assistant: AI-powered email drafting, replying, and summarization within Gmail.

Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the security of your password and accept all risks of unauthorized access to your account
• Notify us immediately if you discover or suspect any security breaches related to the Service
• Take responsibility for all activities that occur under your account

You may not share your account credentials with others. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or used in violation of these Terms.

When using BesideAI, you agree to:

Prohibited Uses

You may not use BesideAI to:

• Infringe upon the rights of others
• Generate, store, or share illegal, harmful, or offensive content
• Engage in harassment, bullying, or discriminatory behavior
• Impersonate any person or entity
• Interfere with the proper functioning of the Service
• Circumvent any access controls or usage limits

Content and Intellectual Property

Your Content

You retain ownership of any content you create, upload, or process through BesideAI ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing the Service to you.

We do not claim ownership over your User Content. However, you are responsible for ensuring that your User Content does not violate any laws or infringe upon the rights of third parties.

Our Content

The Service, including its original content, features, functionality, software, and branding (excluding User Content), are and will remain the exclusive property of BesideAI and its licensors. Our content is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

Subscription Plans and Payment

Free Plan

We offer a free tier with limited features and usage quotas. Free plan users are subject to daily and monthly usage limits as described on our pricing page.

Paid Plans

Paid subscription plans ("Premium Plans") provide access to additional features and higher usage limits. By subscribing to a Premium Plan, you agree to:

• Pay all applicable fees as described at the time of purchase
• Authorize us to charge your designated payment method on a recurring basis
• Provide accurate and complete billing information

Billing

Premium Plans are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• No refunds will be provided for unused portions of the current billing period

Refunds

Price Changes

BesideAI integrates with various third-party services and platforms, including but not limited to:

• Google Meet, Microsoft Teams, and Zoom for meeting translation
• Gmail for email assistance
• AI model providers for content generation and analysis

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

AI-Generated Content

AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing and verifying any AI-generated content before use. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any purpose.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BESIDEAI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages arising from your use or inability to use the Service
• Any damages arising from unauthorized access to or alteration of your transmissions or data
• Any damages arising from statements or conduct of any third party on the Service

Our total liability for any claims under these Terms shall not exceed the amount you paid us, if any, during the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless BesideAI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your User Content

Termination

Termination by You

You may terminate your account at any time by discontinuing use of the Service and deleting your account through the account settings.

Effect of Termination

• Your access to your account and User Content may be disabled

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BesideAI regarding your use of the Service and supersede all prior agreements and understandings.
